General terms and conditions
Academia Now is a trading name of Donker E-Commerce (Chamber of Commerce number 85581461). We are located at Broekseweg 42, 4233CX, Ameide. You can contact us by sending an email to our customer service department. info@academianow.nl.
1. Access to the Platform
You can only create an account if you agree to our terms and conditions. Please enter all your information honestly and keep your username and password confidential. You are responsible for everything that happens through your account. Academia Now may occasionally not work (properly), for example, due to a malfunction or because we are working on improving the site. Academia Now may temporarily take information offline, but we will never do this without good reason.
- These terms and conditions ("Terms and Conditions") govern all use of our platform. You can quickly and easily learn topics on our platform through online videos or assignments (hereinafter: "Platform"). Academia Now may amend these Terms and Conditions at any time. We will notify you in advance of any such amendments. Your continued use of the Platform constitutes acceptance of the amended Terms and Conditions. If you do not wish to accept the amendments, you may discontinue use of the Platform and/or cancel your subscription.
- To use our Platform, you must enter into an agreement with Academia Now ("Agreement"), after which you can create an account and log in with your credentials. You can manage your account and login details as described on the Platform.
- You must keep your login details confidential. As soon as you know or suspect that someone else is using your login details, you must take immediate action, such as changing them. You must also inform us of this.
- You are solely responsible for all use of the Platform through your login credentials. You indemnify us against all third-party claims based on the assertion that your use of the Platform is unlawful in any way.
- The information you provide when entering into the Agreement must be complete and accurate. If this information is no longer accurate, you must update it.
- You are not permitted to: a. ask other users for their login details or log in using someone else's account; b. access or attempt to access the Platform by any means other than using your own login details; c. give someone else access to your account.
- We may always (temporarily) disable the Platform or the information available on it ("Content") and/or restrict its use if this is necessary for providing the Platform, for example for the maintenance of the Platform.
- We do not guarantee that the Platform will be accessible at all times and without interruptions or malfunctions. Disruptions may occur, for example, due to internet or telephone disruptions, viruses, or other errors/defects. We are not liable for or responsible for damages related to the (temporary) unavailability or (interim) failure of the Platform.
2. Use of the Platform
You may only use Academia Now if you behave properly. Respect our platform and other users. By this, we mean being honest, not breaking things, not spamming, not trying to monetize Academia Now (for example, by sharing explainer videos), not discriminating, not bullying, not making jokes, not swearing, or being rude in any other way. If you don't follow these rules, we may ban you from using Academia Now.
- The functionalities of the Platform and the available glossaries depend on the type of account you have.
- Your use of the Platform may not: a. be based on falsehoods, be inaccurate and/or misleading; b. be unsuitable for Academia Now, such as sharing or requesting personal information c. be discriminatory with regard to race, origin, nationality, religion, sex, gender, sexual orientation, disability, illness, culture or heritage or be offensive, hurtful or inappropriate in any way; d. be hateful, incite violence, be threatening and/or intimidating to others; e. be aimed at humiliating or shaming or blackmailing or intimidating a person or user or be disrespectful in any other way; f. contain viruses, Trojan horses, worms, bots or other software that can damage, render unusable or inaccessible, delete or appropriate an automated work or that are intended to circumvent technical protection measures of the Platform and/or Academia Now’s computer systems; g. consist of the use of tools and/or solutions (of third parties) to take over Content, or to spider, scrape or search the Platform in any other way; h. are commercial, such as selling glossaries, products or other items, or sharing advertisements; i. hinder the infrastructure of the Platform; j. are contrary to public decency; k. damage the interests and reputation of Academia Now; l. are in violation of these Terms and Conditions, the Privacy Statement or any law and/or regulation; m. infringe the rights of Academia Now, users and/or third parties, such as IP rights and privacy rights, such as sharing or using private images, texts, photos or music of others without permission; n. distribute spam, distribute repetitive content whether or not via different (fake) accounts or; o. are otherwise unlawful.
- Academia Now can become aware of unlawful use either 1) through a user report or 2) by discovering the unlawful content itself. Academia Now uses machine learning to do this. For example, we use machine learning to train automated checkers to look for specific words, phrases, or violations, making this process faster and more efficient. These results are always reviewed by our own staff. We also use human moderation, reviewing the content users publish, ensuring that contributions are valuable and that user behavior is acceptable.
- If you violate these Terms and Conditions, the Agreement, or if we believe your actions could lead to damage or liability for Academia Now or others, we may restrict, suspend, or disable your use of the Platform at any time. If this happens, we will notify you, clearly explaining why and whether the action is temporary or permanent. We are not liable for any damages related to the unauthorized use of the Platform by you or any other user.
- If you believe that any Content infringes your rights and/or the rights of other users or a third party, you must immediately notify Academia Now using the procedure described in the section Reporting Infringing Content.
- Measures in case of abuse. Here we explain what measures we can take in case of a violation. If you violate our rules, we can take various measures. Depending on the exact context and circumstances, Academia Now can: 1) Remove the content and/or warn the user, 2) Restrict access to (parts of) Academia Now, or 3) Terminate the user's account.
1) We remove content that violates our policies when we discover it. We'll notify you once your content has been removed. Examples of reasons why your content may be removed include:
• The Content is inaccurate or contains errors.
• The Content contains profanities or foul language.
• The Content contains advertisements or links to non-educational websites.
• The Content contains personal information.
• The Content is not relevant to that part of Academia Now, such as questions intended for our customer service.
• The Content contains spam, or you distribute repetitive content through different (fake) accounts.
2) In addition to deleting your Content, we may temporarily or permanently block your access to parts of Academia Now. We will block content that violates our policies as soon as we discover it. We may block your access temporarily (for 7 days) or permanently. If you are blocked, you will no longer be able to use the features that allow you to share Content. You will still be able to use other Academia Now features. We will inform you of the duration of the block and the specific violation once you are blocked.
Examples of when we temporarily block are:
• You post spam, such as irrelevant content, or you distribute repetitive content.
• You post multiple messages (>3) that are not about school.
• You ask multiple inappropriate questions (>3), for example about personal information.
Examples of when we permanently block:
• You have created multiple accounts with unlawful content. The new accounts will then be created solely for the purpose of posting unlawful content and will be permanently blocked immediately.
• You post illegal Content (such as discrimination, bullying, pornography, or other content to harm other users).
• You sell stuff or glossaries.
• You have already been temporarily blocked twice, and this is your third block.
3) We may delete your account if, despite repeated warnings and restrictions, you continue to post content that violates our rules. We will then ensure that you no longer have access to AcademiaNow.
3. Reporting of unlawful content
It's possible that content will be posted on our Platform that violates our rules or disrupts our learning environment. By "content," we mean all user-generated content such as questions, posts, discussions, lists, group messages, chats, comments, and other messages, regardless of the part of our Platform (hereinafter referred to as "Content"). We monitor this ourselves, but we also appreciate receiving notifications from users because we don't see everything. We explain how we handle this here.
- Academia Now is obligated to remove or block access to unlawful Content after receiving a notification. The notification must be accurate and substantiated. Academia Now may also receive an order from a court or competent authority requiring the removal of Content or the release of information.
- Academia Now has a procedure for reporting unlawful content on the platform. To file a report, please go here. If possible, attach a copy of the content in question and briefly explain why you're reporting it. Finally, click "Submit."
- If the Content is clearly unlawful (and the notice is sufficiently precise and substantiated), Academia Now will remove or block the Content.
- Academia Now may decide not to act on a notification, for example, if Academia Now doubts the validity of the notification. In such a situation, Academia Now can request an injunction from a competent court in the Netherlands, declaring that the content is indeed unlawful.
- Academia Now will not be a party to any dispute between the reporter and a third party if a dispute arises from a report.
- The reporter indemnifies Academia Now against all third-party claims related to the blocking or removal of the Content. This indemnity covers all damages and costs that Academia Now suffers, may suffer, or incurs in connection with such a claim, including but not limited to legal fees.
- Academia Now respects and protects the privacy of everyone who reports something. All personal data Academia Now receives as part of a report will always be processed in accordance with privacy legislation and the Privacy Policy and will only be used to process the report.
4. Payment
Academia Now offers free and paid memberships for students up to 18 years old. Are you older than 18? Then choose a paid membership. We sometimes give away a discount code. You can only use this code once. If you choose a paid account, you (or your parents) must pay on time. If you don't pay on time (which can happen), you'll receive a warning. If you still don't pay, you won't be able to log in to Academia Now until you've paid.
- Depending on your account type, you may be charged a fee for using the Platform. When a fee is due, the following applies: You must pay the Platform fee, even if you don't use it. The Platform fee depends on the duration of your membership and the type of package you purchase. The membership types and associated prices are listed on our website, unless otherwise agreed.
- You can pay using the methods described on our website. We may verify payments via credit card or bank account. You will pay within the timeframe stated on our website, unless we have agreed on a different recurring payment method with you and/or direct debit is not or cannot be accepted.
- If no payment term is stated on our website and we have not agreed otherwise with you, you must pay within fourteen (14) days after the invoice date.
- If you fail to pay on time, we will notify you and provide a deadline for payment. If payment is still outstanding, we may suspend or restrict your access to the Platform until you have fulfilled all your payment obligations, including any extrajudicial collection costs and interest. Complaints about invoices and/or the Platform do not suspend your payment obligations.
- We reserve the right to adjust the then-current prices and rates twice per calendar year, in January and September. We do this based on the Consumer Price Index, as published by Statistics Netherlands (www.cbs.nl), or on another basis deemed reasonable by Academia Now. We will inform you of the basis for the price increase.
- You may use a discount code when ordering and paying. The discount code may be linked to a minimum amount and can only be redeemed once. Multiple discount codes cannot be combined. If you redeem a discount code for an order, we reserve the right to charge the original price for the Platform if, due to a cancellation, the total order value is less than the discount code value or if it does not meet the conditions.
5. Intellectual property rights
If you enter your own word list on Academia Now, that list remains yours. However, other people are free to use and copy your lists. Publishers (the companies that produce your textbooks) appreciate it if you use the Academia Now word lists only on Academia Now and don't post them on other websites. This shows respect for the publishers—after all, they created the lists.
- The intellectual property rights relating to the Platform, our website, and the Content published through our website belong to us and/or our licensors. Nothing in these Terms and Conditions is intended to transfer any intellectual property rights to you.
- Subject to the terms and conditions of these Terms and Conditions and for the duration of the Agreement, we grant you a limited, personal, revocable, non-exclusive, non-sublicensable, non-transferable right to access and use the Platform, including our website, and the Content, for the purposes described in these Terms and Conditions.
- You will not perform any actions that may infringe our intellectual property rights, such as registering domain names, trademarks or Google Adwords or requesting or reusing substantial parts of the Platform, our website or the Content or the repeated and systematic requesting or reusing of non-substantial parts of the Platform, our website or the Content as referred to in the Database Act.
- All information, materials, and/or documents you provide to us in connection with the Platform remain your property. We are granted a royalty-free, worldwide, perpetual, irrevocable, non-terminable, unlimited, sublicensable, and transferable license to use and modify the information, materials, and/or documents in connection with the Platform.
6. Guarantees
We try to help you learn subjects as best we can. However, we can't promise that practicing on Academia Now will help you progress academically. The reports we send you and/or show you on Academia Now are based on your playing behavior on Academia Now. You may ultimately score better or worse on a test or quiz.
- We strive to provide our services as effectively as possible. We make no guarantees regarding, for example, the functionality, security, or accuracy of the Content and the Platform, unless otherwise stated in these Terms and Conditions. We are not obligated to add or maintain certain Content or functionalities on the Platform upon request.
- We do not guarantee that your use of the Platform will produce any specific results, such as progress in academic performance.
- The reports we send you about your progress are based solely on your use of the Platform. You cannot derive any rights from these results, reports, statistical overviews, or other information obtained through the Platform.
- We are not responsible for any decision made based on information obtained by you through the Platform.
7. Liability
Have you suffered damages due to Academia Now? Please let us know as soon as possible. If we are indeed liable for your direct damages, we will pay you a maximum of €1,000.
- If we are liable for any damage, we are only liable for the direct damage you suffer. This liability is limited to the fees (excluding VAT) you actually paid us in the current calendar year for the Platform from which our liability arises. In any case, our liability is limited to a (total) maximum of EUR 1,000 per damaging event.
- Direct damage is understood to mean exclusively: a. material damage to property; b. reasonable costs that you would have to incur to bring our performance into line with the Agreement, unless you have terminated the Agreement; c. reasonable costs that you have incurred to determine the cause and extent of the damage, insofar as they relate to direct damage; and d. reasonable costs incurred to prevent or limit direct damage.
- Under no circumstances are we liable for indirect damages. Indirect damages include, but are not limited to, consequential damages, lost profits, lost savings, reduced goodwill, damage caused by third-party materials or software, and damages resulting from the mutilation, destruction, or loss of data or documents.
- The condition for any right to compensation is that you report the damage to Academia Now in writing as soon as possible after discovering it, but in any case within sixty (60) days.
8. Duration
You can subscribe for three months or one year. If you cancel your membership within this period or stop using it, you will not receive a refund. If you don't want your membership renewed, please let us know at least one month before your membership expires that you want to cancel. New customers can take advantage of a free seven-day trial. This gives you the opportunity to see if you like StudyGo.
- The Agreement will enter into force when we provide you with the opportunity to access the Platform for the first time.
Initial duration
- The Agreement is entered into for a fixed term. This term is three (3) months or one (1) year, unless otherwise indicated on the Platform. The Agreement may be terminated at any time, but such termination will not affect the initial term of the Agreement or your obligations under the Agreement. If you cease using the Platform or cancel your membership prematurely, Academia Now is not obligated to refund any prepaid fees for use of the Platform.
Conversion to indefinite term
- After the agreed-upon fixed term as stated in Article 7.2, the Agreement will be automatically and tacitly renewed for the same period as the original subscription term. If you do not want the Agreement to be renewed, you must cancel it via your account no later than one (1) month before the expiration of the term.
Trial period
- You may be eligible for a free trial. This trial lasts seven (7) days, unless otherwise indicated on the Platform. The free trial is only available to new customers. New customers are defined as customers who have not entered into an Agreement with Academia Now in the six (6) months prior to registration. We may determine, at our sole discretion, whether you are eligible for a free trial.
- After the free trial ends, you will be charged the amount corresponding to the first term of the Agreement. This will not happen if you cancel the Agreement through your account before the end of the free trial. You will not receive a notification when the free trial ends, unless otherwise stated on the website.
9. Termination
Once your membership expires, you will no longer be able to log in to Academia Now. Any outstanding Academia Now invoices must be paid immediately.
- When the Agreement ends, you may no longer use the Platform. We will immediately disable your account.
- If the Agreement is terminated by dissolution, the amounts we invoiced for our services prior to that termination will remain due. These amounts become immediately due and payable upon dissolution.
10. Right of withdrawal
If you're not satisfied, you'll get your money back. You must, however, let us know within 14 days. If you have used Academia Now within those 14 days, we are entitled to charge a fee.
- You always have the right to cancel the Agreement within 14 days. You don't have to give a reason.
- If you have used your Academia Now subscription within these 14 days, Academia Now is entitled to charge a fee pro rata to your usage (from the activation of your subscription until the date of cancellation). If you have not used Academia Now within the 14-day cancellation period, cancellation is free of charge.
- The right of withdrawal period starts on the day you confirmed your subscription.
- To exercise your right of withdrawal, you must inform us by means of a clear statement (for example, by email). You can contact us at info@academianow.nl. You must send the statement before the withdrawal period expires.
- Academia Now will then refund the fee you paid to the account number you provided within 14 days.
11. Privacy statement
We don't share any information we have about you (for example, how well you're doing with your practice) with anyone else unless you or your parents give permission, or because it's necessary to offer you Academia Now. Want to know more? Read our Privacy Policy on the website.
- We process the data you provide during the ordering process and the data you provide while using the Service in a secure manner and in accordance with the Privacy Statement and applicable laws and regulations.
12. Other
We hope it never happens, but suppose we have a disagreement (either you disagree with us or we disagree with you) and we can't resolve it together, we'll ask the court for help. A judge will then decide which of us is right and help us resolve our problem.
- If we have given permission, you may transfer your rights and/or obligations under the Agreement with us to a third party. We may transfer our rights and obligations under the Agreement to third parties and will inform you of this transfer.
- The Agreement, these Terms and Conditions and all use you make of our Platform are governed by Dutch law.
- We will submit all disputes arising from and/or related to the Agreement and/or these General Terms and Conditions to the competent court in Amsterdam.
13. Product terms and conditions
These terms apply to physical products sold through the Academia Now webshop (such as posters, planners or booklets).
13.1 Definitions
The usual definitions such as cooling-off period, consumer, distance contract, etc. apply. See our full description at [link].
13.2 The offer
We ensure that our offers are clear and honest. The photos and text are intended to give you the best possible impression of the product. You can contact us if anything is incorrect.
13.3 The Agreement
When you place an order and we confirm it, a contract is formed. After placing your order, you'll receive a confirmation email.
13.4 Right of withdrawal
You have the right to cancel your order within 14 days without giving a reason. You must return the product in its original condition. Once we receive the returned item, you'll get your money back.
13.5 Obligations during the cooling-off period
During the cooling-off period, only use the product as you would in a store. If the product is damaged during use, we may withhold compensation.
13.6 Exercise of right of withdrawal
Please inform us within 14 days that you wish to exercise your right of withdrawal (email to info@academianow.nl ). You then have another 14 days to return the product.
13.7 Exclusion of right of withdrawal
You cannot exercise your right of withdrawal for products that have been made especially for you (e.g. personalized), or for products whose packaging has been broken for hygienic reasons.
13.8 The price
All prices include VAT. Prices are subject to change due to VAT changes or adjustments. Discount codes can only be used once.
13.9 Warranty
We do our best to deliver only quality products. If something goes wrong, please let us know. You're entitled to a good product, and we'll fix it if it's not.
13.10 Delivery
We'll ship your order as quickly as possible, within 30 days at the latest. If something goes wrong or there's a delay, we'll let you know right away.
13.11 Duration transactions
For products that you receive regularly (e.g. monthly boxes), you can always cancel with a notice period of up to one month.
13.12 Product payment
Payment must be made within 14 days of placing your order. If you don't pay on time, we'll send you a reminder. After that, we may charge an administration fee.
13.13 Complaints
Do you have a complaint about your order? Please contact us via info@academianow.nl . We will respond within 14 days. If it takes longer, we'll let you know.
13.14 Disputes
Dutch law applies to everything you buy or do with us. If there's truly something we can't resolve together, you can always go to court in the Netherlands.
13.15 Deviating provisions
Sometimes we make individual arrangements (for example, for a school order). These should never be disadvantageous to you, and we always record them in writing.
14. Terms and Conditions for Pre-orders

Definition and Applicability
These terms and conditions apply to all pre-orders placed with Academia Now. By placing a pre-order, you agree to these terms and conditions. -
Pre-order Process

When placing a pre-order, you will be asked to provide certain information, such as your name, address, and payment information. You are responsible for providing accurate and up-to-date information.

Pre-orders are orders for products that are not yet available for general sale. The expected delivery date is listed on the product page but is subject to change.

Payment

When placing a pre-order, you will be charged the full amount or a deposit, as stated on the product page.

Payment will be processed via the payment methods offered by Academia Now.

Cancellation and Refund

You have the right to cancel your pre-order up until the product ships. If you cancel, the amount paid will be refunded to your account within 14 days.

After the product has been shipped, cancellation is no longer possible, but you can exercise the right of withdrawal as described in our general terms and conditions.

Delivery

The products will be shipped on the estimated delivery date, unless there are unforeseen circumstances.

Academia Now is not liable for delays caused by external factors.

Changes

Academia Now reserves the right to change these pre-order terms and conditions. Any changes will be communicated promptly via our website or by email.

15. Terms and Conditions for Contests

These terms and conditions apply to all competitions organised by Academia Now.

By participating in a contest you agree to these terms and conditions.

Participation

Participation is free and open to natural persons aged 18 or older, residing in the Netherlands or Belgium.

Employees of Academia Now and their immediate family members are excluded from participation.

One entry per person is allowed, unless otherwise stated.

Promotion period

The contest's duration is stated on the promotion page. Participation outside of this period is not possible.

Selection of Winners

Winners will be selected at random from all valid entries.

The draw will take place within 7 days after the end of the promotion period.

No correspondence will be entered into regarding the result.

Announcement and Contact

Winners will be notified personally via the email address provided.

If a winner does not respond within 14 days, Academia Now reserves the right to select an alternative winner.

Prices

The prize is personal, non-transferable and cannot be exchanged for cash or other products.

Any additional costs, such as taxes or travel expenses, will be borne by the winner.

Publication of Winners

For transparency, the names of the winners will be published on a dedicated page on our website, unless the winner objects to publication.

Liability

Academia Now is not liable for any damages resulting from participation in the competition or the use of the prize.

Privacy

Personal data provided in the context of the competition will be processed in accordance with our privacy policy and the General Data Protection Regulation (GDPR).

Other Provisions

Academia Now reserves the right to modify or cancel the contest in the event of force majeure or other circumstances.

These terms and conditions are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam.
